The Office of the Clerk received a Motion from Hon. Joel Bolokoe Mots’oene on the 12th February 2023. The Motion was tabled as follows:
“Due to some certain irregularities happened to the elections of the Senate Presiding Officers, being the President of the Senate and the Deputy President, I hereby present a Motion of no confidence towards/to the House of the Senate before attending the Appropriation Bill, which is going to be presented before the Members of Parliament.”
That is how the Motion oa Morena oa Leribe read.
From the text quoted above, the issues raised are as follows to be dealt with individually:
- Irregularities happened to the elections of the Senate Presiding Officers.
- Motion of no confidence towards the House of the Senate.
- The matter being dealt accordingly before attending the Appropriation Bill.
On the first point which is the irregularities, the mover of the Motion alleges that, there are irregularities that happened during the elections of the Presiding Officers. The said irregularities are not mentioned nor the House being informed as to what those irregularities are, the crux of the matter is that, after the election of the Presiding Officers on the 3rd November 2022, some Senators seemed not to be satisfied with the outcome of the elections, they then indicated in writing that they want ballot re-count believing that there was fraud.
The Senate then resolved that the ballot boxes be opened for re-count. This was done pursuant to Section 6 (5) of the Senate Standing Orders, in the presence of the Transformation Resource Centre Officials and the members of the Lesotho Mounted Police Services as independent observers. The result of the re-count was still the same as the previous results announced on the 3rd November 2022 and the matter came to conclusion as the irregularities that were alleged were ultimately addressed.

On issue number 2 ,The Motion of no confidence towards the house of the Senate
The Motion of no confidence phrase is mostly used in democratic governance where a member solicits support of the majority of members in an organisation to uninstall an authority from the position of power by a majority vote. There is no law in our legal framework that directly or by implication authorities or enables members of Senate to file a Motion of no confidence against the house. The only Motion of no confidence that can be filed in the House is that which is intended to remove the President or Vice President in terms of Section 61(3)€ and 62(4)€ respectively of the Constitution.
On the 08th March 2023 Hon, Joel Mots’oene filed another follow up Motion to that of the 13th February, 2023. The contents of the said Motion pointed out that it was just a follow up of the Motion filed on the 13th February 2023. He was making a plea that the Motion be tabled before the House for Deliberations. There is no Amendment proposed on the Motion but a follow up.
The issue of abolishing or changing the composition of the Senate can only be addressed by a referendum, not by the Motion proposed to the Senate. Furthermore, there are no provisions in our Standing Orders committee to be seized with the matter so that this shall not be a problem in future.
3. The matter to be debated before the Appropriation Bill
The other point of the Motion is to the effect that the Motion be debated before the passing of the Appropriation Bill. The passing of the said Bill is governed by Section 80 of the Constitution of Lesotho. This is a public business which must come before private business. Senate cannot be denied its Constitutional right to debate the Appropriate Bill. The Bill contains finances that shall be used by the entire Basotho Nation including members of this Honourable House. We, therefore, will not consider this because of the above mentioned reasons.
Based on the reasons advanced above, the said Motion is not Supported by any provisions of the law, thereby rendering it void same which I conclude.
Which implies Honourable Senators we cannot as the Motion is written, debate such a Motion because it is unconstitutional.

Therefore Honourable Senators, let me start by observing that today marks an important event on the commitment we have made as a Government to deliver services to all sections of Basotho Nation.

I am collegially known as the Minister of potholes. There is something fishy about potholes that’s a bit weird like cancer. It starts off as a small thing, and if you don’t attend to it, it grows to the size of a big bath tub in the middle of the road. Because a road is a synonym of life, it serves as a reminder that if we don’t do things that we have promised to do over time, we get customed to making promises that are not fulfilled.
So, I beg those of you, who see this as an insignificant event to understand that it is a very significant event atthat. It represents the commitment, and determination of honouring the promises made.It represents a shift in the state of mind and preparedness to correct things, of yesterday, even if you didn’t do them.
It provides assurance that tomorrow will be better than yesterday.
All countries in the world issue different types of number plates for different categories of people; Be it diplomatic, official, protocol or whatever is decided for the ordinary citizens.
Lesotho as a member of SADC, is required by agreements to ensure that its citizens carry the types and formats of number plates that will enable movement across countries.
The Law of the Kingdom, prescribes the type and the format of what we call number plates; what in the Law is called vehicle identification number. The Law also prescribes who can use this type, why and for what purposes.
Honourable Members of the Senate, today we are issuing what we term Protocol Number Plates(PNP). This is a very important symbol in terms of the rights you have, of Privilege. It says if you bear that particular number plate, the Law Enforcement Agencies have to accord you the Protocol you deserve.
With your permission, Madam President, let me observe that during the summer Christmas Campaign we ran, on safety, where we attempted to stop all vehicles to determine speed, drunkenness and all other matter of things. The strategy is to stop everybody! In presumption of that, we infringed upon the Privileges of those who have been granted Privileges in terms of the Constitution.
The reason, we perpetuate that is sometimes because our Law Enforcement Agencies don’t know what the privileged members deserve. Therefore, we have to produce the number plates that are appropriate so that you can be accorded free movement in terms of your said Privileges.
I, of course, observe that Senior Principal Chiefs already bear enough-respect in the community that, Law Enforcement Agencies sometimes don’t even bother to stop them.
From time to time, I have learned that my Principal Chief likes to stop on the road blocks so that he can have a chat with Law Enforcers tocheck that they are doing their work , e.t.c. (laughter)
So, it is in this spirit that we are issuing these number plates.
We, also like to thank your abhorrence and patience because when my predecessors were tempted to issue this erroneous number plates, this House objected to it, on a clear observation that the icon used was that of a royal standard, and not the emblem that we are using. That led to a position where everyone’s number plates that were erroneously issued were recalled and, that was subsequently re-issued.
So, to the people that corrected this in the first place, these are the number plates you shall bear.

Well, we are struggling to get the number plates, so, we will change the strategy for that and make sure that it says you are a member of a certain Constituency in the Eleventh Parliament. That is, even if you don’t return it once the 12th Parliament is in place, which I hope it will be after 5 years, we will know how to retrace the numbers.
So, for these Administration, I again reiterate this is a small major to say let’s return to normality, let’s do things the right way. From here, we will deal with the House of the Representatives and concurrently we will return the issuance of number plates to the citizens.
It will be a remix of me, not to explain why it took so long. It took so long perhaps because we have had financial challenges which simply means paying the service providers that print the number plates for us. We have made sure that they are fully paid so that they don’t have a reason to hold the production of number plates for all Basotho.

5. RESTITUTION OF SENATE BUSINESS
HON. SENATOR N. M. MOTEANE: Madam President, I thank you. In adherance to this Honourable House of the Senate,
this Honourable Senate resolves to suspend Standing Order No. 103(1) which reads as thus:
“(1) At the dissolution or prorogation of Parliament all proceedings then pending shall terminate and lapse.”
And further that this Honourable Senate resolves to evoke Standing Order No. 100(1)(b) which stipulates that:-
In a matter not provided for in these Standing Orders, and in any case of doubt, the President shall:-
(b) Frame and determine a Standing Order until a Standing Order for that matter has been adopted in accordance with Standing Order No. 92(3) (Standing Orders and Staff).
Lastly, this Honourable Senate resolves to adopt this temporary Standing Order to enable restitution of Senate Business and “that the Senate shall resuscitate and consider the following Bills;
- The Tax Administration Bill, 2022
- Protection and Administration of Custom at Initiation Schools Bill, 2022
- Biodiversity Resources Management Bill, 2022
- Public Financial Management and Accountability Bill, 2022
- Rangeland Resources Management Bill, 2021
