REPORT ON TOLL-GATE (AMENDMENT) REGULATIONS, 2025

PART I

  1. INTRODUCTION

The Toll-Gate (Amendment) Regulations, 2025 Regulations, 2025, were tabled on 11th September 2025. Pursuant to Standing Order 51 (3), the Regulations was then referred to the Legislation Committee for consideration.

The report presents a summary of the Committees deliberations and recommendations on the Bill.

1.1 TERMS OF REFERENCE

The terms of reference of the Legislation Committee are provided as follows in Standing Orders (90):

  • There shall be established under this Standing Order a Legislation Committee which shall continue for the term of the Senate.
  • The Legislation Committee shall, in accordance with these Standing Orders:-
  • Consider bills, subordinate laws tabled in accordance with section 27A of the Interpretation Act No. 19 of 1977 as amended, or other matters which are referred to it by the President or by resolution of the Senate;
  • Consider and investigate the constitutionality, legality, conflicting provisions and offensiveness of bills or subordinate laws or any provision thereof; and
  • Perform other functions, tasks and duties as may be resolved by the Senate.
  • The Legislation Committee may:-
  • Call for papers, hear oral evidence, which may, by resolution of the committee, be recorded and transcribed;
  • Consult and liaise with Government ministries and departments;
  • Ensure the attendance of any person at a meeting of the committee in terms of the Parliamentary Powers and Privileges Act of 1994; and
  • Establish sub-committees
  • Upon conclusion of business laid down for their consideration, the legislation Committee must adopt a report and may make recommendations to the Senate which shall then take final decisions.

4.0 OPERATIONS OF THE COMMITTEE

The Committee reviews the Bills referred from the National Assembly in line Standing Order 51 and Subordinate laws referred in accordance with Section 27B of the Interpretation (Amendment) Act of 1993.

PART II

5.0 BRIEF BY MINISTRY OF FINANCE

On Wednesday, 12th September 2025 the Ministry of Finance appeared before the Committee to provide a brief on the Regulations.

The Ministry presented that the Regulations increase the toll fees payable at the borders on entrance into Lesotho for both local and foreign vehicles across different classes. The overall increase in Toll Fees is necessitated by the following:

  1. Decreasing Government funding allocation to Implementing Agencies for road works, the burden thereof is shifted to the Fund hence the need to improve its revenue base.
  2. The ever-increasing demand of funds to meet the increasing road maintenance needs (Deteriorating Road Infrastructure) – The current need (LRMS) is at M15 billion.
  3. The ever-increasing cost of road infrastructure maintenance.
  4. The expanding road infrastructure increases the future maintenance requirements.

PART III

6.0 OBSERVATIONS

The subordinate law ensures that reasonable levies are charged, and enough revenue is collected towards road infrastructure maintenance.

7.0 RECOMMENDATIONS

Toll-Gate (Amendment) Regulations, 2025 be allowed to come into operation.

8.0 CONCLUSION

Subject to Standing Order 52 (3), the Committee wishes to submit the Report for the adoption by the House.
